There are many advantages to small claims court in California. The primary benefit is that there are no attorneys allowed in small claims trials. Thus, expenses are kept fairly low. Another advantage is that a case usually gets to trial faster than in Superior Court.
There are limits as to the amount for which a person or business can sue in small claims court. A person can sue (with certain exceptions) for up to $7,500.00. A business can sue (with certain exceptions) for up to $5,000.00.

In California, a person may not have an attorney represent them in small claims court. However, it is very beneficial to consult with an attorney before going to small claims court. That applies to the plaintiff (the person or business who is suing) as well as the defendant (the person or business being sued). The plaintiff and the defendant should both consult with an attorney before going to small claims court.
Small Claims Appeals
There are strict limitations on which issues may be appealed from small claims court. Also, there are firm deadlines by which a person may file an appeal.
In an appeal of a small claims case, the parties may be represented by an attorney. It is usually advisable to have a lawyer represent a party in a small claims appeal.
